Nonresident may be licensed--examination waived, when.

354.240. 1. A person not a legal resident of this state may be licensedto act in this state as an enrollment representative upon compliance with theprovisions of this chapter provided that the state in which the person resideswill accord the same privilege to a resident of this state. The director isauthorized to enter into reciprocal agreements with the appropriate officialof any other state waiving the written examination of any applicant residingin the other state; provided, the director deems the applicant fully qualifiedand competent; and

(1) That a written examination is required of applicants for similarlicenses in the other state; and

(2) That the appropriate official in that state certifies that theapplicant holds a currently valid license of similar type in that state andeither passed a written examination or was the holder of such license prior tothe time a written examination was required.

2. In the event that the applicant is a resident of a state which doesnot require a written examination, then the director shall subject him to awritten examination under terms and conditions to be prescribed by thedirector of the department of insurance, financial institutions andprofessional registration.

3. In the event that the applicant is a resident of another state inwhich the appropriate insurance official, as a general policy, has refused topermit legal residents of Missouri to become licensed as enrollmentrepresentatives and to transact the business of a health services corporationin such state, then the director shall not license any applicant from thatstate.
