Procedure on appeals--costs--parties--judicial review.

361.095. 1. The state banking board shall make rules andregulations, consistent with applicable law, for the proceedings inconnection with the appeals provided for in section 361.094. No rule orportion of a rule promulgated under the authority of this chapter shallbecome effective unless it has been promulgated pursuant to the provisionsof section 536.024, RSMo.

2. The costs of the appeal shall be assessed against the losingparty, and the board may require the deposit of a reasonable sum for thepayment of costs at the time the appeal is brought.

3. At any hearing provided for in section 361.094 the director of thedivision of finance shall be deemed a party, and any person claiming to beadversely affected and any bank, trust company or national bankingassociation located in the city or town and county in which the proposedbank or trust company is to be located upon incorporation or relocation mayintervene.

4. The director of the division of finance shall act in accordancewith any order of the state banking board made pursuant to section 361.094,but the order of the board shall be subject to judicial review as providedby law. Whether or not any review shall operate as a stay of the board'sorder shall be determined by the board.
