Plaintiff entitled to default judgment, when.

375.271. No plaintiff shall be entitled to a judgment against thedefendant by default under this section until after the expiration offorty-five days from the date of service of summons with copy of plaintiff'spetition thereto attached upon the director of the department of insurance,financial institutions and professional registration, his deputy or chiefclerk as provided in section 375.261, or upon either of the persons referredto in section 375.266.
