Fraudulent claims for benefits--form--notice to department,when--procedure.

375.992. Any company which believes that a fraudulent claim is beingmade shall, within sixty days of the receipt of such notice, send to thedepartment of insurance, financial institutions and professional registration,on a form prescribed by the department, the information requested and suchadditional information relative to the claim and the parties claiming loss ordamages because of the accident as the department may require. The departmentof insurance, financial institutions and professional registration shallreview such reports and select such claims as, in its judgment, may requirefurther investigation. It shall then cause an independent examination of thefacts surrounding such claim to be made to determine the extent, if any, towhich fraud, deceit, or intentional misrepresentation of any kind exists inthe submission of the claim. The department of insurance, financialinstitutions and professional registration shall report any alleged violationsof law which its investigations disclose to the appropriate licensing agencyand prosecutive authority having jurisdiction with respect to any suchviolation.
