Review of rate, rating plan or system, how obtained.

379.348. Any individual, corporation, firm, partnership,association, or any similar entity or combination of theforegoing, aggrieved by any rate charged, rating plan, ratingsystem, or underwriting rule followed or adopted by an insurer orrating organization may request the insurer or ratingorganization to review the manner in which the rate, plan,system, or rule has been applied with respect to insuranceafforded him. Such request may be made by the authorizedrepresentative of such individual, corporation, firm,partnership, association, or any similar entity or combination ofthe foregoing, and shall be written. If the request is notgranted within thirty days after it is made, the requestor maytreat it as rejected. Any individual, corporation, firm,partnership, association, or any similar entity or combination ofthe foregoing, aggrieved by the action of an insurer or ratingorganization in refusing the review requested, or in failing orrefusing to grant all or part of the relief requested, may file awritten complaint and request for hearing with the director,specifying the grounds relied upon. If the director hasinformation concerning a similar complaint he may deny thehearing. If he believes that probable cause for the complaintdoes not exist or that the complaint is not made in good faith heshall deny the hearing. Otherwise, and if he finds that thecomplaint charges a violation of section 379.017 and sections379.316 to 379.361 and that the complainant would be aggrieved ifthe violation is proven, he shall proceed as provided in section379.346.
