Exchange of information--agreement to rates.

379.465. 1. Every rating organization and insurer mayexchange information and experience data with insurers and ratingorganizations in this and other states and may consult with themwith respect to ratemaking and the application of rating systems.

2. With the approval of the director, agreements may be madebetween two or more insurers to adhere to rates, rating plans,rating systems or underwriting practices or uniform modificationsthereof for any of the classes of insurance included in sections379.420 to 379.510.

3. With the approval of the director, agreements may also bemade among insurers with respect to the equitable apportionmentamong them of insurance which may be afforded applicants who arein good faith entitled to but who are unable to procure suchinsurance through ordinary methods, and with respect to the useof reasonable rate modifications for such insurance.

4. Such agreements shall be submitted in written form to thedirector for his consideration together with such information ashe may require to determine whether they are consistent with theprovisions of sections 379.420 to 379.510 and otherwise in thepublic interest.
