Hearings on orders--notice--rules of pleading andevidence--review--effective date of order.

379.505. 1. Any insurer or rating organization aggrieved byany order or decision of the director made without a hearing,may, within thirty days after notice of the order to the insureror organization, make written request to the director for ahearing thereon.

2. The director shall hear such party or parties withintwenty days after receipt of such request and shall give not lessthan ten days' written notice of the time and place of thehearing.

3. Within fifteen days after such hearing the director shallaffirm, reverse or modify his previous action, specifying hisreasons therefor. Pending such hearing and decision thereon thedirector shall suspend the effective date of his previous action.

4. Nothing contained in sections 379.420 to 379.510 shallrequire the observance at any hearing of formal rules of pleadingor evidence.

5. Any order, rule or decision of the director undersections 379.420 to 379.510 shall be subject to review by thecourts of this state as provided in chapter 536, RSMo.

6. No order, rule or decision of the director which issubmitted for judicial review may become effective until afterfinal action or decision by the court, but if approved oraffirmed by the court, such order, rule or decision shall relateback to the date of its making by the director.
