Recording of deeds and security instruments.

381.026. 1. The settlement agent shall present for recording alldeeds and security instruments for real estate closings handled by itwithin five business days after completion of all conditions precedentthereto unless otherwise instructed by all of the parties to thetransaction.

2. Nothing in this chapter shall be deemed to prohibit the recordingof documents prior to the time funds are available for disbursement withrespect to a transaction in which a title insurer, title agency, or titleagent not affiliated with a title agency is the settlement agent, providedall parties to whom payment will become due upon such recording consentthereto in writing.
