Exclusivity of circuit court review procedure--rehearing, procedure.

386.515. Prior to August 28, 2001, in proceedings before the Missouripublic service commission, consistent with the decision of the supremecourt of Missouri in State ex rel. Anderson Motor Service Co., Inc. v.Public Service Commission, 97 S.W.2d 116 (Mo. banc 1936) the reviewprocedure provided for in section 386.510 is exclusive to any otherprocedure. An application for rehearing is required to be served on allparties and is a prerequisite to the filing of an application for writ ofreview. The application for rehearing puts the parties to the proceedingbefore the commission on notice that a writ of review can follow and anysuch review may proceed without formal notification or summons to saidparties. On and after August 28, 2001, the review procedure provided forin section 386.510 continues to be exclusive except that a copy of any suchwrit of review shall be provided to each party to the proceeding before thecommission, or his or her attorney of record, by hand delivery or byregistered mail, and proof of such delivery or mailing shall be filed inthe case as provided by subsection 2 of section 536.110, RSMo.
