Civil action, remedies.

407.1049. In addition to the administrative relief provided insections 407.1025 to 407.1049, any motorcycle or all-terrain vehiclefranchisee may bring an action in any court of competent jurisdictionagainst a motorcycle or all-terrain vehicle franchisor with whom thefranchisee has a franchise, for an act or omission which constitutes anunlawful practice as defined in section 407.1034 to recover damagessustained by reason thereof, and, where appropriate, such motorcycle orall-terrain vehicle franchisee shall be entitled to injunctive relief, butthe remedies set forth in this section shall not be deemed exclusive andshall be in addition to any other remedies permitted by law.
