Health spas, registration with attorney general, form, fee--feesdeposited in health spa regulatory fund, created--attorney general,enforcement, no bar to civil claims.

407.327. 1. It shall be unlawful for any health spa tooffer, advertise, or execute or cause to be executed by the buyerany health spa contract in this state unless the health spa atthe time of the offer, advertisement, sale or execution of ahealth spa contract has been properly registered with the officeof the attorney general. The registration shall:

(1) Disclose the address, ownership, date of first sales anddate of first opening of the health spa;

(2) Be renewed annually; and

(3) Be accompanied by a fee of one hundred dollars perregistration and each annual renewal thereof. Each separatelocation where health spa services are offered shall beconsidered a separate health spa and shall file a separateregistration, even though the separate locations are owned oroperated by the same owner.

2. All fees collected pursuant to this section shall bedeposited in the state treasury to the credit of a special trustfund to be known as the "Health Spa Regulatory Fund". Moneys inthe health spa regulatory fund shall be used solely for theadministration of sections 407.325 to 407.340.

3. The attorney general shall have all powers, rights andduties as are provided in sections 407.010 to 407.145, to seekpenalties, remedies, and procedures that are provided in suchsections against any health spa that is engaged in practices thatare unlawful according to the provisions of this chapter.

4. The provisions of this section* are not exclusive and donot relieve health spas or the contract subject thereto fromcompliance with all other applicable provisions of law nor shallsuch provisions bar any civil claim against any health spa whichhas acquired any moneys or property, real or personal, by meansof any practice declared unlawful by this chapter.
