Penalty, unlawful subleasing--prosecuting attorney, attorney general,duty to commence action, when.

407.740. 1. Any person who willfully and knowingly engagesin unlawful subleasing of a motor vehicle, as defined in section407.742, shall be guilty of a class D felony. It shall be theduty of each prosecuting attorney and circuit attorney in theirrespective jurisdictions to commence any criminal actions undersections 407.738 to 407.745, and the attorney general shall haveconcurrent original jurisdiction to commence such criminalactions throughout the state where such violations haveoccurred.

2. Whenever it appears to the attorney general that aperson has engaged in, is engaging in, or is about to engage inunlawful subleasing of a motor vehicle, he may bring an actionpursuant to section 407.100 for an injunction prohibiting suchperson from continuing such methods, uses, acts, or practices,or engaging therein, or doing anything in furtherance thereof.In any action brought by the attorney general under thissubsection, all of the provisions of sections 407.100 to 407.140shall apply thereto.
