Improper delivery--penalty.

411.641. A warehouseman who delivers grain out of hispossession, knowing that a negotiable receipt, the negotiation ofwhich would transfer the right to the possession of that grain,is outstanding and uncanceled, without obtaining possession ofthe receipt at or before the time of the delivery, is guilty of afelony, and upon conviction shall be punished for each offense byimprisonment by the department of corrections and human resourcesfor not less than two nor more than five years.
