428.135. Any person who records or files in the office of a filingofficer:
(1) Any document purporting to create a nonconsensual common law lienagainst real or personal property; or
(2) A notice of invalid lien pursuant to subsection 2 of section428.110 with respect to a valid lien and which the filer knew to be falseat the time of filing;
shall be liable to the damaged party for actual damages or five thousanddollars, whichever is greater plus costs and reasonable attorney's fees.
