Judgment for defendant, when.

470.130. If it appears that the state has no title in such estate,the defendant shall recover his or her costs, to be taxed and certified bythe clerk, provided that the court find, from the facts, that the title tosuch estate is in the defendant. When such certificate of the clerk isfiled in his or her office, the state treasurer shall pay the certificateas other demands on the treasury.
