Failure of applicant to appear and qualify, effect of.

486.240. If the person for whom a commission is issued fails toappear and qualify within ninety days after the commission is issued, thecounty clerk shall note the failure on the commission and return it withinthirty days of such failure to the secretary of state. The secretary ofstate shall immediately cancel and annul the commission. The secretary ofstate may prohibit, for a period not less than thirty days and not morethan one year, such person from reapplying for an appointment andcommission as a notary public following the failure to appear and qualifywithin ninety days after the commission is issued.
