Assessment of surcharge, exceptions--remittance to sheriffs'retirement fund.

488.024. As provided by section 57.955, RSMo, there shall be assessedand collected a surcharge of three dollars in all civil actions filed inthe courts of this state and in all criminal cases including violation ofany county ordinance or any violation of criminal or traffic laws of thisstate, including infractions, but no such surcharge shall be assessed whenthe costs are waived or are to be paid by the state, county or municipalityor when a criminal proceeding or the defendant has been dismissed by thecourt. For purposes of this section, the term "county ordinance" shall notinclude any ordinance of the City of St. Louis. The clerk responsible forcollecting court costs in civil and criminal cases shall collect anddisburse such amounts as provided by sections 488.010 to 488.020. Suchfunds shall be payable to the sheriffs' retirement fund.
