Surcharge in criminal and infraction cases, exceptions.

488.5017. A surcharge of one dollar, as provided for in section56.765, RSMo, shall be assessed as costs in each court proceeding filed inany court in the state in all criminal cases including violations of anycounty ordinance or any violation of a criminal or traffic law of thestate, including an infraction; except that no such surcharge shall becollected in any proceeding in any court when the proceeding or thedefendant has been dismissed by the court or when costs are to be paid bythe state, county or municipality.
