Petition for commission to take depositions.

492.430. A commission shall be granted to take suchdepositions by any judge of the supreme court, the court ofappeals, or of any circuit court, except a municipal judge, onthe presentation of a petition, in writing, of one or moreparties, supported by his or their affidavit, or the affidavit ofsome credible person, setting forth the nature of his or theirinterest, right or claim, the facts intended to be proved, thenames of the individuals whose testimony is desired, and theplace or places of their residence.
