By whom and how issued--to whom directed.

492.440. The commission shall be issued by the clerk of thecourt in which the judge granting the same presides, and, beingwitnessed by the clerk and the seal of the court, shall bedirected to any judge, associate circuit judge, notary public, orclerk of any court of record, being in the county where suchtestimony is to be taken, requiring such judge, associate circuitjudge, notary or clerk to take the depositions of the witnessestherein named; or, in case the witness or witnesses whosetestimony is desired reside out of this state, such commissionmay be directed to and executed by any clerk or judge of a courtof record or notary public in any of the United States.
