When officer shall act as receiver.

513.110. When a receiver is not appointed, the officerholding the execution shall have all the powers and perform allthe duties of a receiver under section 513.105, and may commenceand maintain actions in his own name as such officer, on debts orevidences of debt seized. He may in such cases be required togive security other than his official bond, but if not sorequired, the sureties on his official bond shall be held liable,as in other cases of his official action.
