Action on bond.

521.780. If the claimant shall be injured or damaged inconsequence of any levy or sale under or by virtue of suchexecution or attachment, and shall in good faith be the owner ofthe interest claimed by him in the property levied on or sold asaforesaid, he, the said claimant, may bring a civil action onsuch bond in the name of the state, to his own use, against suchplaintiff and his sureties, or any or either of them, in theusual manner of bringing actions on penal bonds or may proceedthereon by motion in open court, first giving to the partiesproceeded against in said bond twenty days' notice of suchmotion.
