Parties held under judgment erroneous as to time and place, notentitled to writ.

532.400. No person shall be entitled to the benefit of theprovisions of this chapter for the reason that the judgment byvirtue of which such person is confined was erroneous as to timeor place of imprisonment; but in such cases it shall be the dutyof the court or officer before whom such relief is sought tosentence such person to the proper place of confinement and forthe correct length of time from and after the date of theoriginal sentence, and to cause the officer or other personhaving such prisoner in charge to convey him forthwith to suchdesignated place of imprisonment.
