Aggravated harassment of an employee--penalty.

565.092. 1. A patient or respondent is guilty of aggravatedharassment of an employee when, with intent to harass, annoy, threaten oralarm a person in a facility whom the person knows or reasonably shouldknow to be an employee of such facility or the department of mental healthor to be an employee of any law enforcement agency, the person causes orattempts to cause such employee to come into contact with blood, seminalfluid, urine or feces, by throwing, tossing or expelling such fluid ormaterial.

2. For the purposes of this section, "patient" means any person whois a patient in a facility operated by the department of mental health.For purposes of this section, "respondent" means a juvenile in a securefacility operated and maintained by the division of youth services. Forpurposes of this section, "facility" means a hospital operated by thedepartment of mental health or a secure facility operated by the divisionof youth services.

3. Any person who violates the provisions of this section is guiltyof a class A misdemeanor.
