Investigation of elder abuse--report.

565.186. The department of health and senior services shallinvestigate incidents and reports of elder abuse using the proceduresestablished in sections 660.250 to 660.295, RSMo, and, upon substantiationof the report of elder abuse, shall promptly report the incident to theappropriate law enforcement agency and prosecutor and shall determinewhether protective services are required pursuant to sections 660.250 to660.295, RSMo. If the department is unable to substantiate whether abuseoccurred due to the failure of the operator or any of the operator's agentsor employees to cooperate with the investigation, the incident shall bepromptly reported to appropriate law enforcement agencies.
