Treatment program for first offenders, cost--second offense, nosuspension of sentence or probation.

568.120. 1. Any person who has pleaded guilty to or beenfound guilty of violating the provisions of section 568.020,568.060, 568.080 or 568.090, and who is granted a suspendedimposition or execution of sentence, or placed under thesupervision of the board of probation and parole, shall berequired to participate in an appropriate program of treatment,education and rehabilitation. Persons required to attend aprogram pursuant to this section may be charged a reasonable feeto cover the costs of such program.

2. Notwithstanding other provisions of law to the contrary,any person who has previously pleaded guilty to or been foundguilty of violating the provisions of sections 568.020, 568.060,568.080 and 568.090, and who subsequently pleads guilty or isfound guilty of violating any one of the foregoing sections,shall not be granted a suspended imposition of sentence, asuspended execution of sentence, nor probation by the circuitcourt for the subsequent offense.
