Additional counties may be exempted from provisions of section578.100, procedure.

578.105. If any county of the first class having a charterform of government containing the major portion of a city of overfour hundred fifty thousand inhabitants exempts itself from theapplication of section 578.100 by a vote of the voters of thecounty pursuant to provisions of law permitting such vote, then acounty in the following classification may also exempt itselffrom the application of section 578.100: Any county of thesecond class as of 1977 that is adjacent to any county containinga portion of a city with a population of more than four hundredthousand inhabitants in the 1970 census. The county may exemptitself from the provisions of section 578.100 by submission ofthe proposition to the voters of the county at a general electionor a primary election, and the proposition receiving a majorityof the votes cast therein. The proposal to exempt the countyfrom the provisions of section 578.100 shall be submitted to thevoters of the county upon a majority vote of the governing bodyof the county or when a petition requesting the submission of theproposal to the voters and signed by a number of qualified votersresiding in the county equal to eight percent of the votes castin the county in the next preceding gubernatorial election isfiled with the governing body of the county. The ballot ofsubmission shall contain, but not be limited to, the followinglanguage:

â ã Yes â ã NoIf a majority of the votes cast on the proposal by the qualifiedvoters voting thereon in the county are in favor of the proposal,then the provisions of section 578.100 shall no longer applywithin that county. If a majority of the votes cast on theproposal by the qualified voters voting thereon in the county areopposed to the proposal, then the provisions of section 578.100shall continue to apply and be enforced within that county. Theexemption of any county from the provisions of section 578.100shall not become effective in that county until the results ofthe vote exempting the county have been filed with the secretaryof state and with the revisor of statutes and have been certifiedas received by those officers. The revisor of statutes shallnote which counties are exempt from the provisions of section578.100 in the Missouri revised statutes.

Revisor's note: On November 9, 1978, the results of the election held in Buchanan County on November 7, 1978, were filed with the Revisor's office showing that the electors of Buchanan County had voted to exempt that county from the provisions of this section.

On April 6, 1979, the results of the election held in Cass County on November 7, 1978, were filed with the Revisor's office showing that the electors of Cass County had voted to exempt that county from the provisions of this section.
