Sale of motor vehicles on Sunday prohibited, exceptions--encouragementby certain associations to remain closed on Sundays not a violation ofantitrust laws--violations, penalty.

578.120. 1. Notwithstanding any provision in this chapterto the contrary, no dealer, distributor or manufacturer licensedunder section 301.559, RSMo, may keep open, operate, or assist inkeeping open or operating any established place of business forthe purpose of buying, selling, bartering or exchanging, oroffering for sale, barter or exchange, any motor vehicle, whethernew or used, on Sunday. However, this section does not apply tothe sale of manufactured housing; the sale of recreational motorvehicles; washing, towing, wrecking or repairing operations; thesale of petroleum products, tires, and repair parts andaccessories; or new vehicle shows or displays participated in byfive or more franchised dealers or in towns or cities with fiveor fewer dealers, a majority.

2. No association consisting of motor vehicle dealers,distributors or manufacturers licensed under section 301.559,RSMo, shall be in violation of antitrust or restraint of tradestatutes under chapter 416, RSMo, or regulation promulgatedthereunder solely because it encourages its members not to openor operate on Sunday a place of business for the purpose ofbuying, selling, bartering or exchanging any motor vehicle.

3. Any person who violates the provisions of this sectionshall be guilty of a class C misdemeanor.
