Canteens and commissaries authorized--operation.

630.335. 1. With the approval of the director, the head ofany of the department's mental health or mental retardationfacilities or regional centers may establish and operate acanteen or commissary for the use and benefit of patients,residents and employees.

2. Each facility or center shall keep revenues received fromthe canteen or commissary established and operated by the head ofthe facility in a separate account. The acquisition cost ofgoods sold and other expenses shall be paid from this account. Aminimum amount of money necessary to meet cash flow needs andcurrent operating expenses may be kept in this account. Theremaining funds from sales of each commissary or canteen shall bedeposited monthly in the state treasury to the credit of themental health trust fund. The money in the fund shall beexpended, upon appropriation, for the benefit of the patients inthe improvement of the recreation, habilitation or treatmentservices or equipment of the facility or center from whichderived. The provisions of section 33.080, RSMo, to the contrarynotwithstanding, the money in the mental health trust fund shallbe retained for the purposes specified in this section and shallnot revert or be transferred to general revenue. The departmentof mental health shall keep accurate records of the source ofmoney deposited in the mental health trust fund and shallallocate appropriations from the fund to the appropriateinstitution, facility or center.
