Program standards to be considered--prior to placement.

630.615. Before placing any client in a particular residentialfacility or day program, the department shall consider each of thefollowing criteria:

(1) The best interests of the patient or resident;

(2) Except as provided in subdivision (5) of this section, the leastrestrictive environment for providing care and treatment consistent withthe needs and conditions of the patient or resident;

(3) The ability to provide to the patient or resident that individualdegree of care and treatment which is required for that patient or residentand which is of comparable quality to the existing care and treatment basedupon investigation of the alternative place and its program of care andtreatment;

(4) The relationship of the patient or resident to his family,guardian or friends, so as to maintain relationships and encourage visitsbeneficial to the patient or resident;

(5) Whether the facility will provide the security necessary toprotect the public safety and any crime victim or other witnesses if theclient was committed to the department of mental health pursuant to chapter552, RSMo, based on an accepted plea of not guilty by reason of a mentaldisease or defect excluding responsibility or an acquittal on that basis asprovided in section 552.030, RSMo, for a dangerous felony as defined insection 556.061, RSMo, or a violation of section 565.020 or 566.040, RSMo,or an attempt to commit one of the preceding crimes.
