630.735. 1. No person or governmental unit, actingseparately or jointly with any other person or governmental unit,shall establish, conduct or maintain any residential facility inthis state for the care, treatment, habilitation orrehabilitation of mentally retarded or developmentally disabledpersons without a valid license issued by the department.Licenses in effect on August 13, 1982, shall continue in effectuntil they regularly expire unless sooner revoked; except that inno case shall a license continue in effect beyond one year afterAugust 13, 1982.
2. After October 1, 1983, no person or governmental unit,acting separately or jointly with any other person orgovernmental unit, shall establish, conduct or maintain anyresidential facility or day program in this state for care,treatment, habilitation or rehabilitation of persons diagnosed asmentally disordered or mentally ill or day program for mentallyretarded or developmentally disabled persons unless thefacilities or programs are licensed by the department.
