Emergency procedure.

630.772. If it appears from the petition filed under section198.105, RSMo, or from an affidavit or affidavits filed with thepetition, or from testimony of witnesses under oath when thecourt determines that this is necessary, that there is probablecause to believe that an emergency exists in the residentialfacility, the court shall immediately issue the requested orderfor appointment of a receiver, ex parte and without furtherhearing. Notice of the petition and order shall be served on thehead of the facility or, if personal service is impossible, shallbe posted in a conspicuous place in the facility withintwenty-four hours after issuance of the order. If the petitionis not filed by the attorney general, a copy of the petitionshall be served on the department and upon the attorney general.A hearing on the petition shall be held within three days afternotice is served or posted unless the head of the facilityconsents to a later date. After the hearing, the court mayterminate, continue or modify the temporary order.
