Evaluation of residents required--discharge thereafter.

633.130. 1. At least once every one hundred eighty days,the head of each mental retardation facility shall cause thecondition and status of each resident to be reviewed andevaluated for the purpose of determining whether the residentneeds further residential habilitation, placement in the leastrestrictive environment or discharge.

2. The head of the facility shall initiate proceedings todischarge any resident whose continued residential habilitationis no longer appropriate; except, that the head of the facilitymay refer the resident to the appropriate regional center forplacement pursuant to section 630.610, RSMo.

3. A copy of the evaluation and individualized habilitationplan shall be sent to any court having jurisdiction over theresident.
