Group homes and facilities subject to federal and state law--workerssubject to training requirements--rulemaking authority.

633.300. 1. All group homes and mental retardation facilities asdefined in section 633.005 shall be subject to all applicable federal andstate laws, regulations, and monitoring, including but not limited tosections 630.705 to 630.805, RSMo.

2. All mental health workers, as defined in subdivision (8) ofsection 210.900, RSMo, shall be subject to the same training requirementsestablished for state mental health workers with comparable positions inpublic group homes and mental health facilities. Such required trainingshall be paid for by the employer.

3. Group homes and mental retardation facilities shall be subject tothe same medical errors reporting requirements of other mental healthfacilities and group homes.

4. The department shall promulgate rules or amend existing rules toimplement the provisions of this section. Any rule or portion of a rule,as that term is defined in section 536.010, RSMo, that is created under theauthority delegated in this section shall become effective only if itcomplies with and is subject to all of the provisions of chapter 536, RSMo,and, if applicable, section 536.028, RSMo. This section and chapter 536,RSMo, are nonseverable and if any of the powers vested with the generalassembly pursuant to chapter 536, RSMo, to review, to delay the effectivedate, or to disapprove and annul a rule are subsequently heldunconstitutional, then the grant of rulemaking authority and any ruleproposed or adopted after August 28, 2008, shall be invalid and void.
