Bonds, issuance authorized for operation and maintenance ofsystem--submission to the voters, ballot language, use of money.

650.408. 1. The funds necessary for payment of any obligation of thecounty in connection with the establishment, operation and maintenance ofthe emergency communications system may be paid by the county out of thefund established pursuant to section 650.402, or from bonds issued pursuantto this section.

2. For the purpose of supporting the operation and other purposes ofthe commission and the emergency communications system, the county mayissue bonds for and on behalf of the county, payable out of funds derivedfrom the sales tax authorized in sections 650.396 and 650.399 or fromtaxation of all taxable real property in the county, up to an amount notexceeding six percent of the assessed valuation of such property, with suchevaluation to be ascertained by the assessment immediately prior to themost recent assessment for state and county purposes, or from revenuegenerated from any other tax or fee authorized and approved by the voterspursuant to section 650.399. Such bonds shall be issued in denominationsof one hundred dollars, or some multiple thereof, and the provisions ofsection 108.170, RSMo, to the contrary notwithstanding, such bonds may bearinterest at a rate determined by the emergency communications systemcommissioners, payable semiannually, to become payable no later than twentyyears after the date of the bonds.

3. Whenever the board of commissioners of any such emergencycommunications district proposes to issue bonds pursuant to subdivision (3)of subsection 2 of this section, they shall submit the question to thevoters in the district pursuant to this section. The notice for any suchelection shall, in addition to the requirements of chapter 115, RSMo, statethe amount of bonds to be issued.

4. The question shall be submitted in substantially the followingform:

"Shall ..... County issue bonds in the amount of ..... dollars, thepurpose of which are to support the construction, repair and maintenance ofthe ..... Emergency Communications System?"

5. The result of the election on the question shall be entered uponthe records of the county. If it shall appear that four-sevenths of thevoters voting on the question shall have voted in favor of the issue of thebonds, the commissioners shall order and direct the execution of the bondsfor and on behalf of such county and the commission. If the general law ofthe state is such that an amount other than a four-sevenths majority isrequired on ballot measures of such type, the amount set by the general lawof the state shall control.

6. The county shall not sell such bonds for less than ninety-fivepercent of the par value thereof, and the proceeds shall be paid over tothe county treasurer, and disbursed on warrants drawn by the president orvice president of the board of commissioners and attested by the secretary.The proceeds of the sale of such bonds shall be used for the purpose onlyof paying the cost of holding such election, and constructing, repairingand maintaining the emergency communications system and its appurtenances.

7. Such bonds shall be payable and collectible only out of moneysderived from tax revenues authorized by section 650.399, from the sale ofsuch bonds or from interest that may accrue on funds so derived while ondeposit with any county depositary. The county treasurer shall hold inreserve, for payment of interest on such bonds, a sufficient amount of themoney so derived that may come into his or her hands in excess of theamount then necessary to pay all bonds and interest then past due, to payall interest that will become payable before the next installment of suchspecial tax becomes payable, and three percent of the principal amount ofthe bonds not then due. The county treasurer shall, whenever any of thebonds or interest thereon become due, apply such money as may be in his orher custody and applicable thereto, or that may thereafter come into his orher custody and be applicable thereto, to payment of such bonds andinterest as may be due and unpaid.

8. All money derived from the tax authorized pursuant to section650.399 shall be used in paying the bonds and the interest thereon, exceptthat the money that may be collected pursuant to such tax in excess of theamount necessary to pay all bonds then past due and such bonds and interestas will become payable before another assessment of such tax becomespayable may, less an amount equal to three percent of the principal amountof the bonds not then due, be used for the purposes authorized in section650.411.

9. The county treasurer shall, as such bonds are sold, deliver themto the purchaser upon being ordered to do so by the commissioners. Thecounty treasurer shall cancel bonds as such bonds are paid, and shalldeliver them to the clerk of the county.
