Right to enter premises for compliance inspections or to investigatecomplaints--failure to permit, effect.

660.407. 1. The director, or his authorized representative,shall have the right to enter the premises of an applicant for orholder of a license at any time during the hours of operation ofa center to determine compliance with provisions of sections199.025, RSMo, and 660.403 to 660.420 and applicable rulespromulgated pursuant thereto. Entry shall also be granted forinvestigative purposes involving complaints regarding theoperations of an adult day care program. The division shall makeat least two inspections per year, at least one of which shall beunannounced to the operator or provider. The division may makesuch other inspections, announced or unannounced, as it deemsnecessary to carry out the provisions of sections 199.025, RSMo,and 660.403 to 660.420.

2. The applicant for or holder of a license shall cooperatewith the investigation and inspection by providing access to theadult day care program, records and staff, and by providingaccess to the adult day care program to determine compliance withthe rules promulgated pursuant to sections 199.025, RSMo, and660.403 to 660.420.

3. Failure to comply with any lawful request of the divisionin connection with the investigation and inspection is a groundfor refusal to issue a license or for the suspension orrevocation of a license.

4. The division may designate to act for it, with fullauthority of law, any instrumentality of any politicalsubdivision of the state of Missouri deemed by the division to becompetent to investigate and inspect applicants for or holders oflicenses.
