Manufacturers and dealers to register--commission to issuecertificate, when--registration to be renewed, when,fee--renewals may be staggered.

700.090. 1. Every manufacturer or dealer who sells or offers forsale, on consignment or otherwise, a manufactured home or modular unit fromor in the state of Missouri shall register with the commission each placeof business at which the manufacturer or dealer sells or offers for sale amanufactured home or modular unit.

2. The commission shall issue a certificate of registration to amanufacturer who:

(1) Completes and files with the commission an application forregistration which contains the following information:

(a) The name of the manufacturer;

(b) The address of the manufacturer and addresses of each factoryowned or operated by the manufacturer, if different from the address of themanufacturer;

(c) If a corporation, the state of original incorporation, a list ofthe names and addresses of all officers and directors of the corporation,and proof of the filing of all franchise and sales tax forms required byMissouri law;

(d) If not a corporation, the name and address of the managing personor persons responsible for overall operation of the manufacturer;

(2) Files with the commission an initial registration fee of sevenhundred fifty dollars in the form of a cashier's check or money order madepayable to the state of Missouri.

3. The commission shall issue a certificate of registration to adealer who:

(1) Completes and files with the commission an application forregistration which contains the following information:

(a) The name of the dealer;

(b) The business address of the dealer and addresses of each separatefacility owned and operated by the dealer from which manufactured homes ormodular units are offered for sale if different from the business addressof the dealer;

(c) If a corporation, the state of original incorporation, a list ofthe names and addresses of all officers and directors of the corporation,proof of the filing of all franchise and sales tax forms required byMissouri law;

(d) If not a corporation, the name and address of the managing personor persons responsible for the overall operations of the manufacturer;

(2) Files with the commission an initial registration fee of twohundred dollars in the form of a cashier's check or money order madepayable to the state of Missouri;

(3) Files with the commission proof of compliance with the provisionsof section 301.280, RSMo.

4. The registration of any manufacturer or dealer shall be effectivefor a period of one year and shall be renewed by the commission uponreceipt by it from the registered dealer of a renewal fee of seven hundredfifty dollars for manufacturers and two hundred dollars for dealers and aform provided by the commission upon which shall be placed any changes fromthe information requested on the initial registration form.

5. The commission may stagger the renewal of certificates ofregistration to provide for more equal distribution over the twelve monthsof the number of registration renewals.
