Program to train and license lead inspectors andothers--rules--liability insurance required.

701.312. 1. The director of the department of health and seniorservices shall develop a program to license lead inspectors, riskassessors, lead abatement supervisors, lead abatement workers, projectdesigners and lead abatement contractors. The director shall promulgaterules and regulations including, but not limited to:

(1) The power to issue, restrict, suspend, revoke, deny and reissuelicenses;

(2) The power to issue notices of violation, written notices andletters of warning;

(3) The ability to enter into reciprocity agreements with otherstates that have similar licensing provisions;

(4) Fees for any such licenses;

(5) Training, education and experience requirements; and

(6) The implementation of work practice standards, reportingrequirements and licensing standards.

2. The director shall require, as a condition of licensure, leadabatement contractors to purchase and maintain liability and errors andomissions insurance. The director shall require a licensee or an applicantfor licensure to provide evidence of their ability to indemnify any personthat may suffer damage from lead-based paint activities of which thelicensee or applicant may be liable.
