30-2715.01. Motor vehicle; transfer on death;certificate of title.(1) A person who owns a motor vehicle may provide for thetransfer of such vehicle upon his or her death or the death of the last survivorof a joint tenancy with right of survivorship by including in the certificateof title a designation of beneficiary or beneficiaries to whom the vehiclewill be transferred on the death of the owner or the last survivor, subjectto the rights of all lienholders, whether created before, simultaneously with,or after the creation of the transfer-on-death interest. A trust may be thebeneficiary of a transfer-on-death certificate of title. The certificate oftitle shall include the name of the owner, the name of any tenant-in-commonowner or the name of any joint-tenant-with-right-of-survivorship owner, followedin substance by the words transfer on death to (name of beneficiary or beneficiariesor name of trustee if a trust is to be the beneficiary). The abbreviationTOD may be used instead of the words transfer on death to.(2) A transfer-on-deathbeneficiary shall have no interest in the motor vehicle until the death ofthe owner or the last survivor of the joint-tenant-with-right-of-survivorshipowners. A beneficiary designation may be changed at any time by the owneror by the joint-tenant-with-right-of-survivorship owners then surviving withoutthe consent of any beneficiary by filing an application for a subsequent certificateof title.(3) Ownership of a motor vehicle which has a designation of beneficiaryas provided in subsection (1) of this section and for which an applicationfor a subsequent certificate of title has not been filed shall vest in thedesignated beneficiary or beneficiaries on the death of the owner or the lastof the joint-tenant-with-right-of-survivorship owners, subject to the rightsof all lienholders.
