38-2050. Physician assistants; supervision; supervising physician; requirements;agreement.(1) To bea supervising physician, a person shall:(a) Be licensed to practice medicine andsurgery under the Uniform Credentialing Act;(b) Have no restrictionimposed by the board on his or her ability to supervise a physician assistant;and(c) Maintain an agreement with the physician assistant as providedin subsection (2) of this section.(2)(a) An agreement between a supervisingphysician and a physician assistant shall (i) provide that the supervisingphysician will exercise supervision over the physician assistant in accordancewith the Medicine and Surgery Practice Act and the rules and regulations adoptedand promulgated under the act relating to such agreements, (ii) define thescope of practice of the physician assistant, (iii) provide that the supervisingphysician will retain professional and legal responsibility for medical servicesrendered by the physician assistant pursuant to such agreement, and (iv) besigned by the supervising physician and the physician assistant.(b) The supervisingphysician shall keep the agreement on file at his or her primary practicesite, shall keep a copy of the agreement on file at each practice site wherethe physician assistant provides medical services, and shall make the agreementavailable to the board and the department upon request.(3) Supervisionof a physician assistant by a supervising physician shall be continuous butshall not require the physical presence of the supervising physician at thetime and place that the services are rendered.(4) A supervising physicianmay supervise no more than four physician assistants at any one time. Theboard may consider an application for waiver of this limit and may waive thelimit upon a showing that the supervising physician meets the minimum requirementsfor the waiver. The department may adopt and promulgate rules and regulationsestablishing minimum requirements for such waivers.
