79-528. Reports; filingrequirements; contents.(1)(a) On or before July20 in all school districts, the superintendent shall file with the State Departmentof Education a report showing the number of children from five through eighteenyears of age belonging to the school district according to the census takenas provided in sections 79-524 and 79-578. On or before August 31, the departmentshall issue to each learning community coordinating council areport showing the number of children from five through eighteen years ofage belonging to the learningcommunity based on the member school districts according to theschool district reports filed with the department.(b) Each Class I school district which is part of a ClassVI school district offering instruction (i) in grades kindergarten throughfive shall report children from five through ten years of age, (ii) in gradeskindergarten through six shall report children from five through eleven yearsof age, and (iii) in grades kindergarten through eight shall report childrenfrom five through thirteen years of age.(c) Each Class VI school district offering instruction (i)in grades six through twelve shall report children who are eleven througheighteen years of age, (ii) in grades seven through twelve shall report childrenwho are twelve through eighteen years of age, and (iii) in grades nine throughtwelve children who are fourteen through eighteen years of age.(d) Each Class I district which has affiliated in whole orin part shall report children from five through thirteen years of age.(e) Each Class II, III, IV, or V district shall report childrenwho are fourteen through eighteen years of age residing in Class I districtsor portions thereof which have affiliated with such district.(f) The board of any district neglecting to take and reportthe enumeration shall be liable to the school district for all school moneywhich such district may lose by such neglect.(2) On or before June 30 the superintendent of each schooldistrict shall file with the Commissioner of Education a report describedas an end-of-the-school-year annual statistical summary showing (a) the numberof children attending school during the year under five years of age, (b)the length of time the school has been taught during the year by a qualifiedteacher, (c) the length of time taught by each substitute teacher, and (d)such other information as the Commissioner of Education directs. Onor before July 31, the commissioner shall issue to each learning communitycoordinating council an end-of-the-school-year annual statisticalsummary for the learning community based on the member school districts accordingto the school district reports filed with the commissioner.(3)(a) On or before November 1 the superintendent of eachschool district shall submit to the Commissioner of Education a report describedas the annual financial report showing (i) the amount of money received fromall sources during the year and the amount of money expended by the schooldistrict during the year, (ii) the amount of bonded indebtedness, (iii) suchother information as shall be necessary to fulfill the requirements of theTax Equity and Educational Opportunities Support Act and section 79-1114,and (iv) such other information as the Commissioner of Education directs.(b) On or before December 15, the commissionershall issue to each learning community coordinating council an annual financialreport for the learning community based on the member school districts accordingto the annual financial reports filed with the commissioner, showing(i) the aggregate amount of money received from all sources during the yearfor all member school districts and the aggregate amount of money expendedby member school districts during the year, (ii) the aggregate amount of bondedindebtedness for all member school districts, (iii) such other aggregate informationas shall be necessary to fulfill the requirements of the Tax Equity and EducationalOpportunities Support Act and section 79-1114 for all member school districts,and (iv) such other aggregate information as the Commissioner of Educationdirects for all member school districts.(4)(a) On or before October 15 of each year, the superintendentof each school district shall file with the commissioner the fall school districtmembership report, which report shall include the number of children frombirth through twenty years of age enrolled in the district on the last Fridayin September of a given school year. The report shall enumerate (i) studentsby grade level, (ii) school district levies and total assessed valuation forthe current fiscal year, and (iii) such other information as the Commissionerof Education directs.(b) On or before October 15 of each year, each learning community coordinating council shall issueto the department a report which enumerates the learning community leviespursuant to subdivisions (2)(b) and (g) of section 77-3442 and total assessedvaluation for the current fiscal year.(c) On or before November 15 of each year, the department shallissue to each learning community coordinating council the falllearning community membership report, which report shall include the aggregatenumber of children from birth through twenty years of age enrolled in themember school districts on the last Friday in September of a given schoolyear for all member school districts. The report shall enumerate (i) the aggregatestudents by grade level for all member school districts, (ii) school district levies and total assessed valuationfor the current fiscal year, and (iii) such other information as the Commissionerof Education directs for allmember school districts.(d) When any school district failsto submit its fall membership report by November 1, the commissioner shall,after notice to the district and an opportunity to be heard, direct that anystate aid granted pursuant to the Tax Equity and Educational OpportunitiesSupport Act be withheld until such time as the report is received by the department.In addition, the commissioner shall direct the county treasurer to withholdall school money belonging to the school district until such time as thecommissioner notifies the county treasurer of receipt of such report. Thecounty treasurer shall withhold such money.
