433B.330  Children with emotional disturbance: Approval of admission upon application by parent or guardian.  In any case involving an application from the child’s parent, parents or legal guardian, the child must first be examined and evaluated by the administrative officer or the staff of the administrative officer and admitted to a treatment facility only if, in the judgment of the administrative officer:

      1.  The child can benefit from the program of treatment; and

      2.  Facilities and staff are available and adequate to meet the child’s needs.
