Whenever the commissioner finds that a violation of this chapter or the regulations promulgated hereunder exists and presents an immediate and substantial harm to the health, safety, or general welfare of the public or to the environment, he may order the operator to immediately halt the alleged violation. Service on the commissioner's findings and a copy of the order shall be made upon the operator by the sheriff or a deputy within the county where the operator maintains the mining operation affected by such order. The operator shall comply immediately. Said operator may apply to the commissioner for a hearing on such order, which shall be held within 2 working days after receipt of the request therefor, and shall be conducted pursuant to RSA 12-E:10.
