In all cases where suit is brought and the personal earnings of the defendant are held under the trustee process, and a settlement of the action is made, or tendered, by the defendant or by some other person in his behalf prior to the return day of the writ, the following items of costs, and no more, shall be chargeable to the defendant: The fees of the officer serving the writ as fixed by law and $1 for the writ.
