   I. All decisions regarding the health of the birth mother and the fetus shall be made by the birth mother.
   II. In the case of surrogacy, after birth and prior to:
      (a) The expiration of the period specified in RSA 168-B:25, IV; or
      (b) A surrogate's election to keep the child;
health care decisions regarding the resulting child shall be made by the birth mother or, in the event of her disability, by the intended parents, unless the surrogacy contract otherwise provides.
