If a person absent from the state, for whose minor child a guardian has been appointed, neglects to make provision for the child, and leaves property within the state, the court, upon petition of the guardian and notice, may authorize the guardian to sell at auction or private sale, such portion of the property as the court deems necessary for the comfortable support, education, and maintenance of the minor.
