No person by means of opening gates or dams, other than in the ordinary use of an established water privilege, shall draw down or lower the water in any stream, lake or pond in the state to a degree which will endanger fish life therein until notice in writing has been given to the executive director of such intention 2 weeks prior to such drawing down or lowering so that the department may take out the fish in the waters to be so drawn down or lowered.
