Any person seeking to operate a device tending to inhibit the natural production of ice on public waters in violation of this subdivision shall be, if a natural person, guilty of a violation and if any other person, guilty of a misdemeanor, and the activity enjoined by the court on grounds of public or private nuisance constituting a hazard to public or private safety.
