If any officer or trustee of any savings bank or savings department of a banking and trust company shall knowingly and wilfully violate any of the provisions of law regulating and limiting investments of savings banks, he shall, in addition to the penalties otherwise prescribed, be personally liable for all loss which the bank shall suffer by reason of such illegal investment; and it shall be the duty of the commissioner to sue for and recover such loss in an action of debt for the benefit of such bank.
