§ 113A‑105.  CoastalResources Advisory Council.

(a)        Creation. – Thereis hereby created and established a council to be known as the CoastalResources Advisory Council.

(b)        The CoastalResources Advisory Council shall consist of not more than 45 members appointedor designated as follows:

(1)        Two individualsdesignated by the Secretary from among the employees of the Department;

(1a)      The Secretary ofCommerce or person designated by the Secretary of Commerce;

(2)        The Secretary ofAdministration or person designated by the Secretary of Administration;

(3)        The Secretary ofTransportation or person designated by the Secretary of Transportation; and oneadditional member selected by the Secretary of Transportation from theDepartment of Transportation;

(4)        The State HealthDirector or the person designated by the State Health Director;

(5)        The Commissioner ofAgriculture or person designated by the Commissioner of Agriculture;

(6)        The Secretary ofCultural Resources or person designated by the Secretary of Cultural Resources;

(7)        One member from eachof the four multi‑county planning districts of the coastal area to beappointed by the lead regional agency of each district;

(8)        One representativefrom each of the counties in the coastal area to be designated by therespective boards of county commissioners;

(9)        No more than eightadditional members representative of cities in the coastal area and to bedesignated by the Commission;

(10)      Three membersselected by the Commission who are marine scientists or technologists;

(11)      One member who is alocal health director selected by the Commission upon the recommendation of theSecretary.

(c)        Functions andDuties. – The Advisory Council shall assist the Secretary and the Secretary ofAdministration in an advisory capacity:

(1)        On matters which maybe submitted to it by either of them or by the Commission, including technicalquestions relating to the development of rules, and

(2)        On such othermatters arising under this Article as the Council considers appropriate.

(d)        Multiple Offices. –Membership on the Coastal Resources Advisory Council is hereby declared to bean office that may be held concurrently with other elective or appointiveoffices (except the office of Commission member) in addition to the maximumnumber of offices permitted to be held by one person under G.S. 128‑1.1.

(e)        Chairman and Vice‑Chairman.– A chairman and vice‑chairman shall be elected annually by the Council.

(f)         Compensation. –The members of the Advisory Council who are not State employees shall receiveper diem and necessary travel and subsistence expenses in accordance with theprovisions of G.S. 138‑5. (1973, c. 1284, s. 1; 1975,c. 452, s. 5; 1977, c. 771, s. 4; 1981, c. 932, s. 2.1; 1983, c. 249, ss. 1, 2;1989, c. 727, s. 127; c. 751, s. 8(14a); 1991 (Reg.
